Resolution and Insolvency of Banks and Financial Institutions
Michael Schillig's monograph on Resolution and Insolvency of Banks and Financial Institutions (Oxford University Press, 2016) provides the first comprehensive and systematic exposition of the post-crisis legal frameworks for dealing with financial institutions in distress, analysing the legal regimes applicable in the United States, the European Union, including the implementation in Germany, and the United Kingdom. The book has has informed several recent publications, notably ‘The (Il-)legitimacy of the EU Post-Crisis Bailout Framework,’ (2020) 28 American Bankruptcy Institute Law Review 135-203 and ‘EU Bank Insolvency Law – What Next?’ (2021) 30 International Insolvency Review 239-266. The second edition is currently in preparation and will form the basis of a new research project on the EU’s CMDI reform efforts.
Comparative Company Law
His book on Comparative Company Law, (Oxford University Press, 2019, with C Gerner-Beuerle) constitutes a systematic and coherent volume on comparative corporate law. Following a functional approach, we analyse important policy issues in the areas of corporate law and capital markets regulation on a comparative basis. Our analysis encompasses the corporate laws of the United States, the United Kingdom, Germany and France, as well as the legislative measures adopted by the EU and the relevant case law of the Court of Justice of the European Union. The paperback version of the book is due to be published 2025.
